Terms of Service

These Terms of Service (“Terms”) govern your use of giftstou.com and GiftsToU's digital gift services (the “Service”). By creating an account, making a gift, buying a paid feature, or otherwise using the Service, you agree to these Terms.
1. The Service
GiftsToU lets you create, personalise, preview, and share digital gifts, including letters, birthdays, fireworks experiences, videos, and handmade packages. The available templates, features, prices, and technical requirements may change as we improve the Service.
2. Accounts and eligibility
You must create an account to use creator features and save, publish, or purchase gifts. Provide accurate information, keep your credentials confidential, and tell us promptly if you believe your account has been accessed without permission. You must be at least 13 years old and old enough to enter into these Terms where you live. If you use the Service for an organisation, you confirm that you have authority to bind it to these Terms.
3. Your content and your responsibility
You keep ownership of the content you submit, such as messages, photos, recordings, videos, names, and designs. You grant GiftsToU a limited, non-exclusive, worldwide licence to host, store, reproduce, process, display, and transmit that content only as necessary to operate, secure, improve, and provide the Service and the private links you create.
You are responsible for your content and for obtaining all permissions, releases, and consents needed to use it. Do not upload content that is unlawful, infringing, deceptive, invasive of privacy, threatening, hateful, sexually exploitative, or otherwise harmful. Do not use the Service to send spam, impersonate someone, distribute malware, or interfere with the Service.
4. Gift links and recipients
You choose whom to send a gift link or QR code to. Links are intended to be private, but anyone with a valid link may be able to open the gift. Do not include confidential information in a gift. Recipients do not need to create an account simply to open a shared gift unless a particular feature clearly says otherwise.
5. Paid features, pricing, and refunds
Some core features may be available without charge. Other features, including selected fireworks, premium envelopes, designs, or video generation, may require a one-time payment or another clearly disclosed charge. Before you complete a purchase, we will show the applicable price, currency, and any material purchase terms.
When payment is enabled, payments will be handled through a third-party payment processor. You authorise us and that processor to charge the payment method you provide. Digital features are made available after successful payment and may be consumed immediately; except where law requires otherwise, completed digital purchases are non-refundable. If a paid feature fails to generate because of our technical error, contact us at hello@giftstou.com so we can review a replacement, credit, or refund where appropriate.
6. Intellectual property
GiftsToU, its templates, branding, software, and other Service materials are owned by us or our licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we give you a limited, personal, non-transferable right to use the Service for its intended purpose. You may not copy, reverse engineer, resell, scrape, or exploit the Service except as permitted by law or with our written permission.
7. Availability and changes
We work to keep the Service available and reliable, but it may be unavailable, interrupted, changed, or discontinued from time to time. We may impose reasonable limits to protect the Service, users, and recipients. Keep your own copies of content that matters to you; we do not guarantee permanent availability of any particular feature, template, or gift link.
8. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, harmed other users, or used the Service fraudulently. Clauses that by their nature should survive termination, including those concerning content, intellectual property, disclaimers, liability, and disputes, will survive.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not promise that it will be uninterrupted, error-free, secure, or suitable for every purpose. Nothing in these Terms limits rights that cannot legally be limited. To the maximum extent permitted by law, GiftsToU will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of content, goodwill, profits, or data arising from your use of the Service.
10. Changes to these Terms
We may update these Terms as the Service evolves. The updated Terms will be posted here with a new “Last updated” date. If a change is material, we may provide additional notice. Continuing to use the Service after the effective date means you accept the updated Terms.
